NOTICE TO BIDDERS
Sealed proposals will be received by the Purchasing Panel of the Township of Upper Deerfield, New Jersey at the Municipal Building, 1325 State Highway 77, Seabrook, New Jersey at 10:15 a.m. prevailing time, Tuesday March 3, 2026, and then publicly opened and read aloud for the furnishing and delivery of:
MUNICIPAL WATER & SANITARY SEWER SERVICE IMPROVEMENTS THE HILDRETH TRACT
Specifications and Form of the Proposal have been filed in the office of the Township Clerk, 1325 State Highway 77, Seabrook, New Jersey 08302, and may be inspected there during normal business hours. Copies of said specifications may be obtained at the office of the Clerk, Upper Deerfield Township Municipal Complex located at 1325 State Highway 77, Seabrook, NJ 08302 on payment of a non-refundable fee of $50.00. Checks are to be made payable to the Township of Upper Deerfield.
The Township Committee of Upper Deerfield Township reserves the right to reject any and all bids.

Each bidder must deposit with their bid a certified check, cashier’s check or bid bond in the amount of not less than ten percent (10%) of the total lump sum bid, including all alternates, or $20,000.00, whichever is less, as a guarantee that in the event a contract is awarded to such bidder, he shall promptly execute a contract for work. Upon failure to do so, the bidder shall forfeit the amount of said check or bid bond as liquidated damages and not as penalty. A performance bond, payment bond, and/or maintenance bond is required for their contract. Each bidder shall furnish with its bid a certificate from a surety company stating that it will provide the contractor with the bids required.
Minority and Women Owned businesses are welcome to bid this project. Federal and State wage rates must be adhered to. The highest of the two wage rates and fringe benefits are applicable. Wage rates posted at time of bidding shall be used. No bidder may withdraw their bids within sixty (60) days after the actual date of the opening thereof. Federal Labor Standards require that contractors and subcontractors pay the higher of the Federal or State Wage Rates and fringe benefits in effect at the time the Contract is signed. Bidders are required to comply with the anti-Discrimination Laws of the State of New Jersey, in particular the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27. The statutory language aforementioned as required is hereby incorporated into the Specifications and the Contract with the successful Bidder by reference.
All bids must be accompanied by a copy of the Contractor’s and all subcontractors’ registration certificates or applications for registration through the Federal System for Award Management (SAM). Upon approval of any pending applications for registration, the successful Contractor and any subcontractors must submit copies of the approved registration certificates to the Owner. SAM registration must be renewed and kept current during the course of the Contract.
This federally funded infrastructure project is subject to the FY2024 (SFY2025) requirements of the Build America, Buy America (BABA) Act (Pub. L. No. 117-58, 70901-70953, and 2 CFR Part 184), requiring all iron, steel, and specifically listed construction materials (non-ferrous metals; lumber; and plastic- and polymer-based composite building materials, pipe, and tube) be produced in the United States unless these materials are otherwise exempt or subject to an approved waiver. This requirement, known as the “Build America Preference (BAP),” applies to all federal financial assistance as defined in 2 CFR 200.1 in which funds are appropriated or otherwise made available and used for an infrastructure project, regardless of whether or not the project is funded through the infrastructure investment and Jobs Act (IIJA).
By submitting a bid, the Contractor certifies understanding and compliance with BABA requirements. Contractors and subcontractors shall provide necessary certifications, documentation, and verified information to support compliance or waiver requests throughout the project.
Any corporation or partnership submitting a bid shall submit with their bid, or prior thereto, a list of the names and addresses of all shareholders or partners who own ten percent (10%) or more of the corporation or partnership.
